Terms of service
These Terms of Service ("Terms") set forth the conditions for using the online shop ("Service") provided on this website by Aoishima Inc. ("we", "us", or "our company"). All registered users ("Users") agree to use the Service in accordance with these Terms.
Article 1 (Applicability) These Terms apply to all aspects of the relationship between Users and the Company regarding use of the Service. We may establish additional rules or provisions ("Individual Provisions") relating to the use of the Service. Any such Individual Provisions, regardless of their title, shall constitute an integral part of these Terms. If there is any inconsistency between these Terms and the Individual Provisions, the Individual Provisions shall prevail unless otherwise specified.
Article 2 (User Registration) To use the Service, a prospective user must agree to these Terms and apply for registration via a method designated by the Company. Registration is deemed complete when the Company approves the application and notifies the applicant. We reserve the right to reject any application at our sole discretion and are under no obligation to disclose the reasons for such rejection.

Article 3 (User ID and Password Management) Users are responsible for managing their own user ID and password. Users may not transfer, lend, or share their user ID and password with third parties. Any login using a matching user ID and password will be considered the action of the registered User. We are not responsible for any damage resulting from unauthorized use of login credentials unless caused by our intentional misconduct or gross negligence.
Article 4 (Sales Contract) A sales contract is formed when a User submits a purchase request and we confirm acceptance of that request. Ownership of the product transfers to the User when we hand the product over to the delivery service. We may cancel a sales contract without prior notice to the User in the following cases:

Article 5 (Intellectual Property Rights) Copyrights and other intellectual property rights for all content, including product photos provided through the Service, belong to us or to other rightful owners. Users may not use such content without permission through reproduction, distribution, modification, or other secondary uses.
Article 6 (Prohibited Conduct) Users must not engage in the following when using the Service:

Article 8 (Usage Restrictions and Account Termination) We may restrict the use of the Service or delete a User’s account without prior notice if:

Article 9 (Withdrawal) Users may terminate their account by following the designated withdrawal procedures.
Article 10 (Disclaimer and No Warranty) We make no warranties that the Service is free of defects, including safety, reliability, accuracy, completeness, effectiveness, fitness for particular purposes, or security. We shall not be liable for any damages incurred by Users through the Service. However, if the contract between the User and the Company falls under a consumer contract as defined in the Consumer Contract Act, the above disclaimer does not apply. Even then, our liability is limited to damages directly caused by our negligence (excluding gross negligence) and does not include indirect or consequential damages. We are not responsible for disputes, communications, or transactions between Users or between Users and third parties in relation to the Service.
Article 11 (Changes to the Service) We may change the content of the Service or discontinue the Service without notice and are not liable for any resulting damages to Users.
Article 12 (Changes to Terms of Service) We may modify these Terms at any time without notice if deemed necessary. Continued use of the Service after changes indicates acceptance of the revised Terms.
Article 13 (Handling of Personal Information) We will handle personal information obtained through the use of the Service appropriately in accordance with our Privacy Policy.
Article 14 (Notices and Communications) Notices between Users and the Company shall be made via a method specified by us. Unless a User notifies us of a change in contact details, we may assume the registered contact is valid, and communication to that contact shall be deemed delivered at the time of dispatch.
Article 15 (Prohibition of Transfer of Rights and Obligations) Users may not assign or transfer their position under the service agreement or their rights or obligations under these Terms to a third party without our prior written consent.
Article 16 (Governing Law and Jurisdiction) These Terms shall be governed by the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to the Service. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over our head office location.
